Harassment based on National Origin

Though harassment based on national-origin claims are available under Title VII, the harassment must be so severe or pervasive that the workplace becomes a hostile environment. In evaluating harassment claims, the courts will look at whether the conduct was

(a) physically threatening;

(b) pervasive throughout the work environment;

(c) whether a reasonable person would find the conduct offensive and/or hostile; and

(d) whether the individual’s response indicated that they found the conduct offensive and/or hostile.
