Complaint Costs

Generally, it costs no money for a person or a group to file a charge under Title VII. It does, however, cost an employer a significant amount of time and money to prepare and defend a claim. This is particularly true if the employer hires an attorney to defend the claim.

Many of the charges filed with the Equal Employment Opportunity Commission (EEOC) are not investigated by that agency. Often, if there is a state enforcement agency charged with investigating anti-discrimination charges brought under state statute, the EEOC will defer its investigation until the state agency investigation is completed. The EEOC has a “work-sharing” agreement with the state agency (706 agency). If the state agency dismisses the charge, the EEOC will also dismiss the case unless the person filing the charge has additional information to present to support a different conclusion.
